Society statement on outcome of Pimlico Plumbing case

Members may have seen press reports on the outcome of a legal case where the Supreme Court made a ruling on the status of a self-employed contractor.

The Supreme Court made a ruling that, in fact, he was not a contractor but a worker. As a worker he was therefore entitled to holiday pay etc. but also his tax position would change from being self-employed.

The outcome of this case may affect Podiatrists who are employed in Private Practice as ‘Associates’.

Organisations should undertake an audit of those arrangements to assess whether their consultants could in fact be deemed to be workers.

Whilst this decision is fact-sensitive, it does provide useful authority on the status of contractors.
